Terms and Conditions

I. SCOPE

The following General Terms and Conditions govern the use of this online facility and the delivery of tickets to the person placing an order (customer) by Promotion GmbH (Contra Promotion).

II. CONTRACTING PARTIES

The purchase of a ticket creates a contractual relationship between the purchaser and Contra Promotion GmbH, Hellweg 24, 44787 Bochum, if Contra Promotion appears as the event organiser. In other cases, Contra Promotion only appears on behalf of and in the name of the respective event organiser, which is solely responsible for rendering and performing the service offered. The purchase of a ticket only creates a contractual relationship with this event organiser.

III. CONCLUSION OF CONTRACT

The display of an event on this website does not constitute a binding offer for the purchase of a ticket. The person placing the order makes a binding offer to conclude the contract by clicking ‟I accept the General Terms and Conditions”. Contra Promotion accepts this offer by sending a confirmation message via e-mail. Its acceptance of the offer is subject to the condition precedent that the customer has provided correct and complete information for the delivery of the tickets and process payment.

IV. CANCELLATION

The ticket purchaser does not have the right to revoke an off-premises contract, as described in Section 312b of the German Civil Code, for recreational event promotion, especially of concerts and similar events. The right to revoke the contract and return goods within two weeks does not apply. As a result, a binding contract is concluded when confirmed by Contra Promotion, and this confirmation obliges the person placing the order to accept and pay for the ticket.

V. PRICES

The price of the tickets on offer includes an advance-booking fee and statutory VAT. A delivery charge is added to the price. Its amount depends on the delivery method chosen by the customer.

VI. DELIVERY TERMS

Customers bear the cost of delivery for tickets ordered. If the customer is a consumer and chooses to pay on delivery or by credit card, he or she bears the delivery risk. If Contra Promotion is delayed in delivering tickets, the customer is entitled to set a reasonable deadline for delivery and, if delivery has not taken place by this deadline, to withdraw from the contract. Contra Promotion accepts no liability for simple negligence in the event of losses resulting from late delivery or non-delivery.

VII. PAYMENT TERMS

The price of tickets ordered is payable in full, including all fees, immediately after the contract is concluded (through the confirmation e-mail). Tickets remain the property of Contra Promotion until full payment is received. In the event that a payment is not made properly or is reversed, Contra Promotion is entitled to recall the tickets.

VIII. WARRANTY

Contra Promotion assumes no responsibility for the correctness, completeness and topicality of information provided unless this is the result of gross negligence or intent. Customers must check tickets immediately after delivery to verify that they are correct and complete. Complaints must be sent to Contra Promotion via e-mail within three working days. The person placing the order may only demand damages instead of service as described in Section 437 No. 3 of the German Civil Code if Contra Promotion, its legal representative or agent have violated their duties through gross negligence or intent.

In case of loss there is no ticket replacement.

IX. DATA PROTECTION

Contra Promotion processes customers’ personal information in compliance with applicable data protection provisions. Information that customers provide (name, address, e-mail address, telephone number, credit card number, etc.) is used solely to effect and complete the contractual relationship. If third parties are contracted to handle this contract, Contra Promotion is entitled to provide them with the information necessary for their task.

X. EVENT TERMS

The event terms in this section are only valid when Contra Promotion appears as the event organiser. They govern the contractual relationship between the guest and Contra Promotion in terms of event execution. If Contra Promotion is simply brokering tickets for another event organiser, other general terms and conditions may also apply. Unless agreed otherwise, guests are not guaranteed a seat at events. For losses other than death, bodily injury and health detriment, no liability will be assumed unless Contra Promotion, its legal representative or agent have violated their duties through gross negligence. If an event is cancelled, the ticket purchaser is entitled to a refund of the purchase price less the advance-booking fee and other fees. Tickets remain valid if the event is cancelled but rescheduled for another date. Customers may not lodge a claim against Contra Promotion for a refund of any other expenses. Events are governed by the house rules at the event venue. To ensure that events take place as planned, guests agree to follow the directions of security personnel and door staff. Weapons and other dangerous objects that might cause harm to other people are prohibited. Cameras and other recording devices are also prohibited. Contra Promotion has the right to refuse admission to the event location if guests violate the above terms. In such cases, customers may not lodge a claim against Contra Promotion for a refund of the ticket price. Food and beverages from outside the event may not be brought into the venue. Door staff are entitled to search guests at the entrance and confiscate any prohibited items.

XI. FINAL PROVISIONS

German law shall apply exclusively. The place of performance is the headquarters of Contra Promotion. If the customer is a merchant, the headquarters of Contra Promotion shall be the exclusive forum of jurisdiction for any disputes arising from this contractual relationship. If any part of these provisions is invalid, this will not affect the validity of the contract or of the remaining terms and conditions.

XII. IMAGE RIGHTS

Guests automatically relinquish rights to the use of video and photographic images that are made of them during events.

XIII. TICKET RETURNS

If a concert is cancelled and not rescheduled, customers can return their tickets for a refund of the ticket price up to six months after the date when the concert was to take place. Tickets returned after this date are not eligible for a refund. Customers receive a refund of the purchase price less the advance-booking fee and other fees. Advance-booking fees and other fees cannot be refunded.
